In accordance with the settlement agreement between the United States and Attentive Energy, LLC on March 23, 2026, the Department of the Interior has cancelled and rescinded Lease No. OCS-A 0538.
Lease History
On September 20, 2024, Attentive Energy LLC submitted a Construction and Operations Plan (COP) to BOEM for the Attentive Energy Two Offshore Wind Energy Project. The Project proposes to develop a 1,545 megawatt (MW) commercial offshore wind energy facility.

On February 23, 2022, BOEM held an offshore wind auction for six lease areas in the New York Bight area. Attentive Energy LLC was identified as the winner of Lease Area OCS-A 0538 (84,332 acres) located in federal waters approximately 36 nautical miles (nm) offshore New Jersey and 47 nm offshore New York.
Background
On February 23, 2022, BOEM held an offshore wind auction for six lease areas in the New York Bight area. Attentive Energy LLC was identified as the winner of Lease Area OCS-A 0538 (84,332 acres) located in federal waters approximately 36 nautical miles (nm) offshore New Jersey and 47 nm offshore New York.

Site Assessment Plan
On January 20, 2023, Attentive Energy LLC submitted a Site Assessment Plan (SAP) to install and operate a floating light detection and ranging (FLiDAR) buoy to assess meteorological and oceanographic conditions on this lease area. A revised SAP was submitted on October 30, 2023. After review and coordination with other agencies, BOEM approved this SAP on December 19, 2023. The buoy was decommissioned in April 2025.
Construction & Operations Plan

BOEM is no longer reviewing the COP.
Environmental Review
BOEM prepared a Programmatic Environmental Impact Statement (PEIS) that analyzed potential impacts from anticipated offshore wind energy development in the six New York Bight lease areas and issued a Record of Decision. Progress Reports
As required by the lease, Attentive Energy is required to submit progress reports to BOEM every six months until approval of a Construction and Operations Plan. The intent of the progress reports was to improve Lessee communication and transparency with Tribes and other parties, including:
- Coastal communities
- Commercial and recreational fishing industries
- Educational and research institutions
- Environmental and public interest non-governmental organizations
- Federal, state, and local agencies
- Federally recognized Tribes
- General public
- Mariners and the maritime industry
- Ocean users
- Submarine cable operators
